Who are we?
SERVICES CONSEILS LANDMARK INC. (“LANDMARK”) is a commercial real estate advisory firm focused on the representation of commercial tenants, whose goal is to stand out and be the driver of change in a transactional industry by using a relationship-centered model. We have offices in Montreal (our head office), Calgary (Alberta), and Fernie (British Columbia).
Consequently, LANDMARK is directly responsible for the processing of the personal information in its possession, all in accordance with the legislation in force.
What personal information do we collect?
We may collect and process various types of personal information in the course of delivering our services and activities, including the following:
- The personal information of our directors, officers, employees, and (where applicable) representatives of the clients we represent, namely their first and last names, mailing address, email and telephone number, social insurance number, and banking information;
- Information related to the recruitment of directors, officers, or employees, such as resumes and other relevant information;
How do we collect your personal information?
We collect your personal information in several ways:

- To meet and comply with legal, regulatory, or risk-management obligations.
With whom do we share personal information?
We may share or give access to your personal information (in addition to our directors, officers, and employees, where applicable) with certain third parties, including the following:
- Third-party service providers and/or partners who provide us with website services, administrative support, maintenance, and other services;
- Agents, insurers (such as the Fonds d’assurance responsabilité professionnelle du courtage immobilier du Québec, or FARCIQ), professionals, other regulators, or parties outside Quebec.
As these third parties may have access to or process personal information in connection with the services they provide to us, we limit the sharing of or access granted to these service providers to only the information that is reasonably necessary to enable them to perform their duties (where applicable).
To this end, we require these providers to undertake, by contract or through confidentiality agreements, to take all reasonable and lawful measures to ensure the confidentiality and protection of this personal information;
- Governmental, regulatory, or law enforcement bodies (for example, to detect or prevent fraud) when we are required to disclose such information or if we believe in good faith that such disclosure is necessary to comply with applicable laws.
How long do we retain personal information?
We will retain your personal information for the fulfillment of the purposes for which this personal information was provided to us and for any related authorized purposes.
We will therefore dispose of your personal information as soon as the purposes in question have been fulfilled or as soon as you withdraw your consent in this regard, subject to applicable regulatory or legal provisions.
Where do we store personal information, and international transfers
Most of your personal information is stored on our servers and/or those of our IT service providers located in the province of Quebec.
How do we protect personal information?
We recognize that information security is an integral part of the confidentiality of personal information. This is why we implement best practices to ensure the protection of personal information in accordance with applicable legislation.
To this end, we maintain reasonable physical, technical, organizational, and legal safeguards to protect your personal information against any unauthorized access, use, modification, disclosure, and/or destruction that is not compliant with the legislation in force.
All members of LANDMARK and the third-party providers whose services we may retain and who process personal information on our behalf are also contractually bound to respect the confidentiality of personal information.
Applicable laws: As we primarily collect the personal information of natural persons residing in the province of Quebec, this Privacy Policy as well as our governance rules regarding the protection of personal information meet the criteria and requirements of that province’s law, namely the Act Respecting the Protection of Personal Information in the Private Sector. What rights does a person have with respect to their personal information?
Rights of access, rectification, and withdrawal of consent
To access your personal information, to request a rectification of your personal information, or to withdraw your consent to the disclosure or use of your personal information, you must submit a written request to our Personal Information Protection Officer (PIPO), whose contact details can be found at the end of this Policy.
The rectification request must be particularly precise and must correctly identify you to enable us to adequately correct or complete the personal information deemed inaccurate or incomplete. Where applicable, such a request to withdraw consent could result in the termination of the services our organization provides to the person concerned.
Processing of requests
The PIPO will normally respond to requests for access, rectification, or withdrawal of consent within 30 days, in accordance with the time limits prescribed by the Act Respecting the Protection of Personal Information in the Private Sector.
All necessary assistance will be reasonably provided to the persons concerned who wish to access or rectify their personal information, including in clarifying exactly what they are looking for.
In the event that we must deny a person access or any other request relating to their personal information for legal, regulatory, or other reasons, written notification will be provided.

If you are not satisfied with the way the PIPO has handled your request for access to or rectification of your personal information, in particular in the event of no response or an unsatisfactory response, you may file a request for review of a disagreement with the Commission d’accès à l’information.
